TelMaar terms and conditions

These terms and conditions apply to all use of TelMaar, the financial platform by Mega Software. By creating an account or using TelMaar, you agree to these terms. The Dutch version of these terms is leading; this English version is provided for convenience.

Article 1. Definitions

In these terms, the following definitions apply: Mega Software: the provider of TelMaar. TelMaar: the financial software platform offered via telmaar.nl and portal.telmaar.nl. Customer: the natural or legal person who creates an account or uses TelMaar. Account: the customer's access to TelMaar. Company: an administrative unit set up within the customer's account.

Article 2. Applicability

These terms apply to every offer, every use of TelMaar and every agreement between Mega Software and the customer. Deviations are only valid if agreed in writing.

Article 3. Account and access

The customer is responsible for keeping login details confidential and for all activity that takes place through the account. Two-factor authentication is mandatory for users with a financial role. If the customer suspects misuse of the account, they must report this to Mega Software immediately.

Article 4. Subscription and trial period

TelMaar is offered on a subscription basis, per organisation. An organisation may contain multiple companies; the subscription applies to the organisation as a whole. New accounts may use a trial period as stated on the pricing page. After the trial period ends, the chosen subscription starts, unless cancelled in time.

Article 5. Prices and payment

Current prices are listed on /prijzen. All stated amounts exclude VAT, unless stated otherwise. Price changes are announced at least 30 days in advance. Payment follows the billing method stated on the pricing page.

Article 6. Rules of use

The customer uses TelMaar only for lawful purposes and in a way that does not adversely affect availability for other users. It is not permitted to use TelMaar to send misleading or fraudulent invoices or communication.

Article 7. Availability and maintenance

Mega Software makes an effort to keep TelMaar available, but does not guarantee uninterrupted availability. Planned maintenance is announced in advance wherever reasonably possible.

Article 8. Data and ownership

All data the customer enters into TelMaar remains the customer's property. The customer can export their data at any time. Mega Software uses the customer's data solely to provide the service, not for its own commercial purposes. Mega Software does not use customer data to train language models or any other models, and imposes the same obligation on the parties it engages.

Article 9. Privacy and processing

For the processing of personal data, please refer to the /privacyverklaring and the /verwerkersovereenkomst. These documents form part of the agreement between Mega Software and the customer. Which cookies TelMaar places and why is set out in the cookie statement at /cookies. TelMaar places only strictly necessary and functional cookies and uses no tracking cookies.

Article 10. Intellectual property

All intellectual property rights to TelMaar, including software, design and documentation, belong to Mega Software or its licensors. The subscription grants the customer a right of use, not an ownership right to the software.

Article 11. Liability

Mega Software's liability for damages arising from the use of TelMaar is limited to the amount the customer paid to Mega Software in the preceding twelve months. This limitation does not apply in case of intent or deliberate recklessness on the part of Mega Software.

Article 12. Cancellation

The subscription can be cancelled monthly, with no minimum term. After cancellation, the account remains available until the end of the current billing period. The customer can export their data before or after cancellation.

Article 13. Changes to these terms

Mega Software may change these terms. Material changes are announced in advance. Continued use of TelMaar after a change constitutes acceptance of the amended terms.

Article 14. Applicable law and disputes

These terms are governed by Dutch law. Disputes are submitted to the competent court in the district where Mega Software is established, unless mandatory law provides otherwise.
